Do You Need a Permit for a Dumpster in Fort Worth?
Usually not, if the dumpster sits on your own driveway or property. A can in the street, an alley or on a sidewalk needs the city’s permit. In Fort Worth, that is a temporary street use permit. In Burleson, it is a right-of-way permit.

Where does Fort Worth require a dumpster permit?
Two sections of the Fort Worth City Code cover this. Section 30-12 bars private use of any part of the public right-of-way without the city’s express permission. Section 30-75 covers material or rubbish from building work on a public street, alley or sidewalk. It calls for a written permit from the director of public works. Both rules cover public space.

Do you need a permit for a dumpster on your driveway?
Usually not. The street rules cover public space, and your driveway is private property. On a residential dumpster rental, we set the can on the driveway or elsewhere on the property. Hard, level ground makes the drop and the pickup easier. Keep the whole can on your side of the sidewalk. Not sure where your lot ends? Ask the city.
Two checks still apply on private property. Your HOA’s rules can reach the driveway. In Burleson, the right-of-way rule also names easements, so ask the city if one crosses your spot.
What does Fort Worth’s street use permit take?
The permit runs through the city’s Transportation and Public Works department. Its requirements sheet and application form were both revised in April 2025. They include these four requirements.
- Lead time: at least 3 to 5 business days.
- Fee: paid before you get a copy of the issued permit. The April 2025 sheet listed $112.50. The fee ordinance effective October 1, 2026 lists $266 for a residential address and $296 for a commercial one.
- Insurance: a certificate of insurance that lists the City of Fort Worth on the policy.
- Traffic control plan: a plan that shows the lanes to be closed. The city posts typical plans online. A site-specific or modified plan needs an engineer’s seal.
The city’s basic insurance list calls for $1,000,000 per occurrence in general liability. Its risk management department reviews exceptions. That paperwork is one reason a driveway spot is the simpler path.
Fees change, so confirm the current amount with Transportation and Public Works before you apply. You can apply through the city’s online street permit system.
What if the dumpster stays in the street more than three days?
Fort Worth adds a second permit for longer stays. The city requires a temporary encroachment permit when a private project blocks the right-of-way for more than three days. It carries a daily charge based on the square feet the can covers. Posted rates differ between city documents, so ask for the current one.
What about a time limit on the can itself? The city code has a seven-day rule, but it is narrow. Section 12.5-831 says commercial waste containers must be emptied at least once every seven days. The code defines those as dumpsters for commercial garbage and rubbish, and it does not name roll-offs.
Our standard rental is 7 days. If you need it longer, call us and we will set up more time. If the can fills early, ask for a swap. We empty it and bring it back.
What are Burleson’s rules for a dumpster in the street?
Burleson requires a right-of-way permit to block or obstruct a city road. The same rule covers placing “construction or other material” on a city road, right-of-way or easement. Public Works handles these permits. The city’s page does not name dumpsters, but a can in the street blocks part of the road.
The application is an online form, the Right-of-Way Permit Application and Locate Request. It asks for start and completion dates and a map or drawing of the work area. If a lane will close, it asks for a site-specific traffic control plan. The page posts no fee and no lead time. The form does ask the contractor to call the city’s right-of-way inspector at least 48 hours before work begins.

Do HOA rules apply to a dumpster?
They can, and they are separate from the city. A city permit covers public space. Your HOA’s deed restrictions can cover what sits on your lot, the driveway included.
Texas law says where to find those rules. The Texas Property Code requires an HOA to file its deed restrictions and rules in the county’s real property records. HOAs with 60 or more lots must also post them on a website members can reach. So must any HOA that uses a management company.
Fort Worth’s list of neighborhood organizations includes HOAs in newer subdivisions like Summer Creek and Chisholm Trail Ranch. Read your HOA’s rules before drop day. If they call for approval, get it in writing first.
Who applies for the permit, you or the dumpster company?
You do, or your contractor does. Fort Worth’s form opens with a Contractor / Applicant Name field and asks for a copy of current insurance. Burleson’s form asks for an applicant name and a company. On a remodel or a new build, your contractor can be the applicant.

What should you do before drop day?
